The primary purpose of the Mental Capacity Act is to promote and safeguard decision-making within a legal framework. The Deprivation of Liberty Safeguards is the procedure prescribed in law when it is necessary to deprive a resident or patient who lacks capacity to consent to their care and treatment of their liberty in order to keep them safe from harm.

This course provides you with the knowledge, skills, and confidence to care and health staff to support, protect and empower people who may lack capacity.

Aims of the Course

By the end of the course learners will:

  • Be able to define and discuss what the term mental capacity means

  • Be able to discuss and state who is affected by the act and how consent is gained

  • Be able to discuss and evaluate the five core principles of the act

  • Understand how mental capacity is assessed

  • Understand the role of the court of protection

  • Be able to define the term ‘Deprivation of Liberty’

  • Understand safeguards including risk assessments

  • Understand the assessment and authorisation process under Deprivation of Liberty
